The Housing Cooperative Society allotted a plot to the petitioner in the year 1981 but subsequently by mischief of the said Society, the said plot was allotted to one Mr. Ramaotar Sharma. In between, the land in dispute over which the Housing Society carved out the plots, was acquired by the Jaipur Development Authority but eventually it was later on deacquired. The original size of the plot No.B-101, Parivahan Nagar, Khatipura, Jaipur, was 280 square yards but subsequently its size was reduced to 161 square yards. The petitioner was supplied information by the Jaipur Development Authority under Right to Information Act that his name stands in the list of allottees submitted by the Housing Society. There was, therefore, no question of the same plot being allotted to said Ramaotar Sharma. It is alleged that the Officers of the J.D.A. Were also hand-in-glove with the office bearers of the Housing Society and petitioner, in this manner, has been cheated by fabrication and forgery of records. It is submitted that the Investigating Officer was playing in the hands of the office bearers of the Housing Society. He rather pressurized the petitioner to compromise the matter with the Housing Society. He offered three options to the petitioner, namely, to accept the land at a distant place in another housing scheme of the same Housing Society, to become party to the civil suit which the Housing Society has filed against the Jaipur Development Authority for return of the land or accept money with interest.
