Petitioners have filed this petition under Section 438 Code of Criminal Procedure, 1973 seeking anticipatory bail in F.I.R. No.2 191201 6 registered at Police Station Nainwa, District Bundi (Raj.) for offences u/Ss. 3, 4 & 5 Prize Chits and Money Circulation Schemes (Banning) Act 1978 and 420 Indian Penal Code 1860.

Prosecution story in brief is that the petitioner and their co-accused had taken a shop on rent and were doing the business of chit fund lotary. In this regard Shiv Raj Sharma was joined during
investigation and he stated that for the last one month petitioner No.1 had taken shop on rent and had opened office in the name of Jai Ambey Enterprises. It is further the case of the prosecution that petitioners and their co-accused used to take Rs. 10001-, Rs. 15001- & Rs. 15001- in three instalments from public and assured them that prizes would be given in lotary.
Keeping in view that the petitioners are > specifically named in the FIR and the seriousness of the allegations levelled against them, no ground,.-*f@r ' $$.t grant of anticipatory bail to them is made out Dismissed.
