well as the learned Public Prosecutor and perused the record of the case.

Learned counsel for the accused-applicant submits that charge sheet in the case has been filed and as the trial is likely to take time, the accused-applicant may be enlarged on bail in the case triable by the Magistrate. The petitioner undertakes not to commit same or other offence during period of bail on its grant.

Learned Public Prosecutor has opposed this bail

After considering all the facts and circumstances of

the case and without expressing any opinion on merits of the case, which may otherwise affect outcome of the trial but looking to the facts available on record, I am of the view that accused-applicant deserves to be enlarged on bail.

II BAIL APPLICATION – 8222/2016

Accordingly, the bail application under Section 439 Cr.P.C. is allowed. It is ordered that accused-applicant, namely, Naresh Soni be released on bail in FIR No.60/2016 registered at Police Station Ramganj, District Ajmer for offence under Section 19/54 of Rajasthan Excise Act provided, he furnishes a personal bond in the sum of Rs.50,000/- together with one surety in the like amount to the satisfaction of the learned trial Court for his appearance before that Court on all subsequent dates of hearing and as and when called upon to do so.

It is made clear that if the accused-applicant is found committing same or other offence during period of bail, the Prosecution would be at liberty to seek cancellation of this bail order.
