Mr. T.C. Sharma, learned counsel for the petitioner submits that injured Ramniwas is a habitual offender, who criminally trespassed in the house of present applicant from the roof of house. The daughter of present petitioner was sleeping in night and the injured tried to commit rape with her. However, when she awoke and cried, after hearing her cry, the family members woke up, thereupon the injured jumped from the roof of the house of present applicant to stones, due to which he sustained injuries. The report by Tida Ram, husband of present petitioner regarding this incident was submitted on 8.4.2016 at Police Station Bansur, but the same was not registered. Thereafter, report was sent to Superintendent of Police, Alwar on 9.4.2016, even then the first information report was not registered. Thereafter a complaint was filed by the husband of petitioner on 11.4.2016 before learned Judicial Magistrate, Bansur on which FIR bearing no.184/2016 for offence under Sections 323, 354, 376, 511 and 457 IPC was registered. He further submits that from the injury report of injured Ramniwas, it reveals that there is only one grievous injury due to fracture of left ulna bone. None of the injuries is dangerous to life.
