Heard learned counsel for the parties.

Learned counsel for the petitioner Shri Suresh Dhenwal submits that petitioner is in custody since 05.12.2015. Alleged offence is triable by First Class Magistrate and the allegation against him is with regard to stolen of motorcycle and trial may take its own time. Therefore, he may be granted benefit of bail.

Learned Public Prosecutor on the other hand opposed the bail application.

On consideration of submissions made on behalf of the respective parties and the material made available for my perusal, but without expressing any final opinion on the merit and de-merit of the case, I am inclined to grant benefit of bail to the accused-petitioner, the bail application filed under Section 439 Cr.P.C. is allowed.

It is ordered that the accused-petitioner Dinesh Kumar Saini S/o Shri Laxmi Narayan in F.I.R. No.370/2015, registered at Police Station Vidhyadhar Nagar, Jaipur, shall be released on bail; provided he furnishes a personal bond of Rs.50,000/- and two surety bonds of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to

do so. However, it is made clear that if in future the involvement of the petitioner in same type of offence is found, the prosecution will have a liberty to file application seeking cancellation of this bail order before the Sessions Court concerned and the learned Sessions Judge will have liberty to cancel this bail order without reference to this Court.
