Heard learned counsel for the accused-applicant as well as the learned Public Prosecutor and perused the record of the case.

It is stated that accused-applicant has been acquitted in eight cases and only one case is pending against him, other than the present one. Looking to the aforesaid, he may be enlarged on bail.

Learned Public Prosecutor has opposed this bail

application.

After considering all the facts and circumstances of the case and without expressing any opinion on merits of the case, which may otherwise affect outcome of the trial but looking to the facts available on record, I am of the view that accused-applicant deserves to be enlarged on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed. It is ordered that accused-applicant, namely, Barkat @ Sheru be released on bail in FIR No.152/2016 registered at Police Station Civil Lines, District Ajmer for offence under Sections 143, 323, 341, 342 & 365 IPC provided, he furnishes a personal bond in the sum of Rs.50,000/- together with one surety in the like amount to the satisfaction of the learned

trial Court for his appearance before that Court on all subsequent dates of hearing and as and when called upon to do so.

It is made clear that the Court would release the accused-applicant after verification of the fact that only one case is pending against him other than the present one. If more than one case is found pending against the accused-applicant, other than the present one, he would not be released, rather the bail, granted

today, would be treated as cancelled.
