Instant application has been preferred under Section 439 of Code of Criminal Procedure, 1973 for grant of regular bail to the petitioner in a case arising out of First Information Report No.340/2015 registered at Police Station, Pahadi District Bharatpur for offences punishable under Sections 147, 148, 149, 323, 341, 325, 336 and 302 of Indian Penal Code.
Complainant in the First Information Report has specifically stated that the petitioner, along with Muvin has caused injury with lathi on the head of the deceased.
At this stage, Mr. Kapil Gupta, learned counsel appearing for the petitioner, has prayed that he may be permitted to withdraw the present application, with liberty to renew prayer for bail, after statement of the complainant is recorded by the ld. trial Court.
As prayed, present application is, hereby, dismissed as withdrawn with liberty aforesaid.
