Petitioner has filed this petition under Section 439 Code of Criminal Procedure 1973 seeking regular bail in F.I.R. No. 123/2013 registered at Police Station Harmara, Jaipur for offence under Sections 19/54 & 54A of the Rajasthan Excise Act, 1950 (hereinafter referred to as Act).
Heard.
Liquor was recovered from the Truck owned by the petitioner. Petitioner is in custody since 16.4.2016. Co-accused Bhanwar Lal has been ordered to be released on bail by this court vide order dated 16.8.2013.
Keeping in view the facts and circumstances of the case, it would be just and expedient to order the release of the petitioner on bail.
Accordingly, without expressing any opinion on the merits of the case, this petition is allowed. Petitioner be admitted to bail subject to satisfaction of the Trial Court.
