�ाथ� ने यह अि�म जमानत �ाथर्नाप� धारा 438 दण् ड �ि�या संिहता के तहत �स् तुत कर जमानत पर स् वतं� िकये जाने की �ाथर्ना की है।
�ाथ� के िव�ान अिधवक् ता �ाथ� की ओर से �स्तुत इस जमानत �ाथर्नाप� को इस स्वतं�ता के साथ वािपस लेने की अनुमित चाहते ह� िक �ाथ� के अपर सेशन न्यायाधीश, चौमूं के सम्ष समपर्ण कर जमानत �ाथर्नाप� पेश िकये जाने की अवस्था म� उ� न्यायालय को उसके जमानत �ाथर्नाप� को िनयमानुसार िनस्तािरत िकये जाने का िनद�श िदया जावे।
िव�ान लोक अिभयोजक एवं पिरवादी के िव�ान अिधव�ा ने इसका िवरोध िकया।
�ाथ� के िव�ान अिधव�ा को �ाथ� की ओर से �स्तुत इस जमानत �ाथर्नाप� को वािपस लेने की अनुमित �दान की जाती है। �ाथ� की ओर से �स्तुत यह जमानत �ाथर्नाप� अन्तगर्त धारा 438 दण्ड �ि�या संिहता वािपस िलये जाने के आधार पर िनरस्त िकया जाता है। यिद �ाथ� उपरो� व�णत न्यायालय के सम्ष समपर्ण कर अपना जमानत �ाथर्नाप� �स्तुत करता है तो उसके ऐसे जमानत �ाथर्नाप� का िनस्तारण िविध अनुसार शी� िकया जावे।
