This bail application has been filed under Section 439 CrPC.

Brief facts of the case are that an FIR No.168/2016 was lodged at Police Station Lalsot,Dausa for the offences mentioned therein, whereupon the investigation was commenced. During the course of investigation, the petitioner/s was/were arrested. He/she/they moved the bail application before the court below, which was dismissed. Hence, this bail application has been filed.

Learned counsel for the petitioner/s has contended that petitioner/s has/ have falsely implicated in the matter. Petitioner/s is/are in judicial lock up since long and the trial of the case will take time,hence he/she/they should be released on bail.

I have heard learned counsel for the parties and carefully perused the relevant material on record.

Looking to the facts and circumstances of the case, but without expressing any opinion on the merits and demerits of the case, I deem just and proper to enlarge the petitioner/s on bail.

Therefore, this bail application is allowed and it is

directed that accused petitioner/s Ram Kishore son of Ramphool shall be released on bail under Section 439 CrPC in connection with aforesaid FIR provided he/she/they furnish(es) a personal bond of Rs. 10,00,000/- (ten lac) along with a surety in the like amount which shall be attested by the concerned revenue authority to the satisfaction of the trial court with the following conditions:

(i) that the accused petitioner/s will appear before the SHO concerned twice in a month till six months for his/their personal appearance.

(ii) that the concerned SHO shall mark attendance of accused petitioner/s in Rojnamcha, and if the petitioner/s fail/s to appear before the concerned Police station, the SHO is directed to inform the PP. The learned PP shall move an application under section 439(2) Cr.P.C for cancellation of bail of the petitioner/s in accordance with law;

(iii) that the concerned trial court or the Magistrate where the bail bonds are submitted by the petitioner/s shall send the copy of this order to the concerned SHO immediately;

¶23

(iv) that the accused petitioner/s shall appear before the concerned trial court on all subsequent dates of hearing and as and when called upon to do so.
