"इस िववा्यक के स�ब�ध म� गवाह ए. ड. 1 �ीमती रामभजनी उफर् रामभजना का कथन है िक उसके पित शंकरलाल गाय भ�से रखते थे दूध डेयरी का काम था उसके पास जीप भी थी िजसके मािलक पित ही थे जीप

के न�बर 386 थे। माह के दस हजार �पये कमा लेते थे सारे पैसे सा्षी को घर के िलए देते थे। सा्षी के दो ब�चे ह� लडकी सोनू चार पांच साल की व लडका िदलराज तीन साल का है, सास का नाम मनभरदेवी है जो सा्षी के साथ ही रहती है पित की बिहन का नाम इ�्शा है दाह सं�कार म� 18-20 हजार �पये खचर् हो गये। ्ऺितपरी्षा म� सा्षी का कथन है िक उसके पित के कोई भाई नहीं था वह अकेला था। गवाह ए. ड. 3 मनभर का कथन है िक शंकरलाल उसका बेटा था जो 28 साल का था, गाय भ�से रखता था डेयरी का काम करता था उसके �वयं के नाम से जीप थी। एक्जी.15 से एक्जी.26 जीप की मािसक िक�त की रसीद� ह� शंकरलाल दस ग्यारह हजार �पये मािसक कमा लेता था। गवाह ए. ड. 4 ्ऺहलाद का कथन है िक शंकरलाल उसका दो�त व पडौसी था वह गाय भ�से रखता था डेयरी का काम करता था दूध स�लाई करता था एक जीप भी उसके पास थी शंकर बताता था िक दस ग्याहर हजार �पये कमा लेता है उसकी 28-30 साल थी।

म�ने मृतक शंकरलाल की पो�ट माटर्म िरपोटर् एक्जी. 2 का अवलोकन िकया इसके अनुसार मृतक शंकर की उ्ा मृ�यु के समय 35 वषर् थी। साि्षय� ने मृतक की उ्ा 28 अथवा 30 साल होना बताया है पर�तु इसका कोई्ऺ माण पेश नहीं िकया है ऐसी ि�थित म� मृतक की उ्ा 35 वषर् मानना ही उिचत होगा और इस उ्ा को देखते

हुए इस मामले म� आय की गणना हेतु 17 ( स्ऴह) का िकया जाना उिचत होगा। मृतक की आय गुणांक ्ऺयु्व के ्ऺमाण म� भी कोई ठोस ्ऺलेखीय सा�य ्ऺ�तुत नहीं हुई है यह अव�य है िक जीप संख्या आर. जे. - 26 सी- 0386 का मृतक रिज�्िेशन ्ऺ माण प्ऴ एक्जी. 13 के अनुसार व बीमा कवर नोट एक्जी. 14 के अनुसार पंजीकृत �वामी था। एक्जी. 15 से एक्जी. 26 रसीद� को देखने से जािहर होता है िक इस जीप के िलए फाईने�सर को 5650/ - �पये ्ऺितमाह की दर से िक�त� चुकानी पडती थी उसे देखने से यह अव�य जािहर होता है िक मृतक की आय जीप से िनि�त �प से इतनी तो अव�य होती होगी िक वह इन िक�त� की अदायगी कर पाता होगा। मृतक की गाय भ�स व डेयरी से भी आय ्ऺा� करने की सा�य पेश हुई है य्यिप आयकर अदा करने स�ब�धी कोई ्ऺलेखपेश नहीं हुआ है तथािप इस त�य को �यान म� रखते हुए िक कृिष व कृिष कायर् से होने वाली आय पर कोई आयकर देय नहीं होता, मृतक की आय जीप व डेयरी दोन� ध�ध� से कुल िमलाकर 6000/ - �पये मािसक से कम िकसी भी ्ऺकार से नहीं मानी जा सकती है यिद इसम� से एक ितहाई रािश मृतक �वयं अपने ऊपर खचर् करता तो मृतक की आय से ्ऺाथर् को होने वाली कुल्ष ित 4000x12x17=8, 16, 000/ - �पये बनती है। दुघर्टना �व�प शंकरलाल की मृ�यु होने से ्ऺ ाथर्गण उसके लाड �यार, �नेह सेवा संर्षण आिद से वंिचत हो गये अत: इस मद म� ्ऺाथर्गण को ्ऺितकर �व�प 10000/ - �पये तथा मृतक के दाह सं�कार म� हुए खच� के मद म� ्ऺितकर �व�प 5000/ - �पये िदलाये जाने

उिचत ह� इस ्ऺकार ्ऺाथर्गण िविभ�न मद� म� ्ऺितकर �व�प कुल 8, 31000/ - �पये ( अ्षरे आठ लाख इकतीस हजार �पये) िवप्षीगण संख्या एक लगायत तीन से संयु्व �प से व पृथक पृथक �प से ्ऺा� करने रािश म� से अंतिरम पंचाट म� के अिधकारी है उ्व िदलायी गयी रािश का समायोजन िकया जावे।"
