This appeal is preferred to challenge order dated 4.2.2014 passed by learned Single Bench dismissing S.B. Civil Writ Petition No.14833/2013.

The factual matrix necessary to be noticed for adjudication of instant appeal is that the respondents conducted a competitive test for the purpose of appointment as Patwari as per provisions of the Rajasthan Land Revenue (Land Records) Rules, 1957. The petitioner faced process of selection and was placed in the select list. Some of the persons who too faced the process of selection, by way of filing a petition for writ challenged the answers settled by respondents in their answer-key. The challenge so given came to be decided by this Court with direction to the respondents to get the question-paper and their answers given in the answer-key examined through Expert Committee.

On basis of the recommendations made by the Expert Committee the result of competitive test came to be revised and

the petitioner who was earlier placed in the select list did not find place therein. By way of filing petition for writ, the petitioner questioned correctness of the recommendations made by the Expert Committee with regard to two questions. A direction was again given to examine correctness of answers relating to the questions indicated by the petitioner as wrong. The Expert Committee did not find any wrong with the answers settled, hence the petitioner again approached this Hon`ble Court by way of filing a petition for writ.

The writ petition aforesaid came to be dismissed by the judgment impugned dated 4.2.2014. The learned Single Bench observed that the recommendation made by the Expert Committee does not require any interference as there was no allegation of bias or malafide or of any extraneous consideration.

In appeal, the argument advanced by learned counsel for the appellant is that the answers settled by the respondents relating to two questions are patently wrong and that has effected the entire select list said to be made on basis of merit. The questions pointed out by the learned counsel are :-

For the question no.24, as per official answer-key, the correct answer is option “(b)” i.e. “बन�स” and for the question no.55, the answer settled is option “(a)” i.e. “बह�ब�हह”. It is submitted by learned counsel that the correct answer for the first question is option “(c)” and for the second question is i.e. option “(d)”.

We are of the considered opinion that while exercising powers under Article 226 of the Constitution of India a writ court is not required to sit over the opinion given by the Expert Committee, however, as in the instant matter learned counsel for the appellant urged that the answers given in the official answer-key are patently illegal and that demands examination on merits. It is also stated that the expert has given finding but no reason. By citing a book an effort is made to prove the finding wrong. Having considered the insistence we deemed it appropriate to look into merits.

So far as the first question is concerned, we are of the opinion that the correct answer proposed by the appellant i.e. option “(c)” “चमबल” is apparently wrong in view of the fact that the river aforesaid originates in the State of Madhya Pradesh and merges with river Yamuna in the State of Uttar Pradesh and the flow of that in the State of Rajasthan is only about 130-135 Kms. On the other hand, river Banas originates from Aravali Hills in the State of Rajasthan and passes through a distance of about 525 kms. Hence, the answers given in the official answer key is correct.

Now coming to the second question, the term “सम�स” means compounding a phrase to coin a new small word. The word “ननर��क�र" is a compounding word of phrase “ननर र�क�र ह� ज�”.

Literal meaning of the word “ननर��क�र” is “who is having no expression” but it is used for “God”. As discussed above, “बह�ब�हह सम�स” is compounding of two words and each of the words is not related to the newly coined word. Neither “ननर” nor “र�क�र” are having any co-relation with “all mighty God”, that means “ननर��क�र”. In view of it, we are having no hesitation in holding that the answers given in the answer-key about this question is also correct.

The appeal, thus, is devoid of merit, hence, dismissed.
