The petitioners were appointed on the post of Multipurpose Health Worker (Male) and at present they are posted in their respective districts. They are claiming the 1^st , 2^nd and 3^rd selection grades on completion of 9, 18 and 27 years of service in the pay scale corresponding to the existing pay scale as specified in Para No. 5 and likewise, as the case may be, as per the Circular dated 25.01.1992 and subsequent Circular dated 17.02.1998 issued by the Finance Department.

It is stated that similarly situated persons including one Shri Dadam Das Vaishnav preferred S.B. Civil Writ Petition No. 8309/2012 (Dadam Das Vaishnav Vs. State of Rajasthan & ors.) before this Court. The said writ petition was allowed vide Judgment dated 20.05.2013 directing the respondents to allow first selection grade to the petitioner in the pay scale of Rs. 4000-

6000 w.e.f. 11.02.1991 and 2^nd and 3^rd selection grades in terms of Para No. 5 of the Circulars dated 25.01.1992 and 17.02.1998. Aggrieved, the State Government preferred a special appeal i.e. D.B. Civil Special Appeal (Writ) No. 738/2014 (State of Rajasthan & ors. Vs. Dadam Das Vaishnav). The said special appeal has been dismissed vide Judgment dated 02.07.2014. Thereafter, the Additional Director (Admn.), Department of Medical & Health Services has also issued Order dated 05.09.2014 in compliance of the judgment rendered in the case of Dadam Das Vaishnav (supra) and other similar matters.

In view of the above, the present petition is disposed of with the direction to the respondents to consider and decide the case of the petitioner in the light of the judgment dated 20.05.2013 passed by this Court in S.B.Civil Writ Petition No.8309/2012 (Dadam Das Vaishnav Vs. State of Rajasthan & Ors.) within one month of the receipt of copy of this order and grant necessary relief, in case, the petitioner is found covered with the said judgment.
