The prayer in the present writ petition is to set aside the final selection list of Teacher Grade III Level I dated 16.03.2015 and appointment order dated 18.03.2015 qua the petitioner with a further prayer to re-determine the complete list of allotment of Panchayat Samities.

It is contended that the petitioner was selected on the post of Teacher Grade III Level -I and was placed at S.No.217 which is high in the merit but he was posted to Panchayat Samiti Balesar. The petitioner filled up his first choice as Panchayat Samiti, Luni whereas his last choice was at Panchayat Samiti, Balesar but he has not been granted the posting as per his priority and merit. It is stated that the persons less meritorious than the petitioner have been posted according to their merit and at their desired place.

Reliance is placed on the judgment rendered by this Court in the case of Surendra vs. State of Rajasthan & ors. (SB Civil Writ Petition No. 9526/2012) decided on 25^th September, 2012 .

Looking into the facts of the present case, this Court deems it proper to dispose of the present petition with a direction to the respondents to consider the case of the petitioner in the light of the judgment of this Court rendered in the case of Surendra (supra) as expeditiously as possible preferably within one month of the receipt of this order and grant the necessary relief, if the petitioner is found entitled and covered by the same. In case the petitioner is aggrieved with any adverse order, he is at liberty to challenge the same afresh.
