Heard learned counsel for the petitioner and Mr. S.S. Ladrecha, Additional Advocate General, who appears on caveat on behalf of the respondents.
It is submitted by learned counsel for the petitioner that the petitioners were working as Vidhyarthi Mitra and as the petitioners are above 35 years of age, their applications for grant of appointment under the Rajasthan Vidhyalaya Sahayak Subordinate Service Rules, 2015 ('the Rules') have not been considered and their online application form has not been accepted.
Reference has been made to Rule 41 of the Rules providing for power of relaxation with the respondents.
A further reference has been made to order dated 03.09.2015 passed in S.B. Civil Writ Petition No. 9738/2015 Anil Kumar Ojha vs. State of Raj. & Ors., wherein this Court has directed as under:-

“Having regard to the facts & Circumstances of the case, the writ petitions are disposed of requiring the petitioners to submit representation to the appropriate authority for giving them age relaxation by exercising power under Rule 41 of the Rules of 2015. Upon receiving such representation, the appropriate authority shall objectively consider and decide the same by a reasoned order within a period of three weeks from the date of submission. In the meantime, the respondents shall accept the hard copy of the petitioners application for recruitment in the ongoing recruitment process for selection as Vidhyalay Sahayak. However, the petitioner's right of selection shall remain subject to the final order which may be passed on his/her representation seeking age relaxation.
No order as to costs.”
In view of the order passed by this Court in the case of Anil Kumar Ojha (supra) , the writ petition filed by the petitioner is also disposed of in view of the above order and with similar directions. The offline applications be accepted, if filed by the petitioners by 17.09.2015.
