An application has been filed seeking early hearing of the restoration application.
For the reasons indicated in the application, the same is allowed. The restoration application is taken up for orders.
The restoration application is barred by 37 days. Learned counsel for the respondent has no objection to the condonation of delay in filing restoration application and restoration of the appeal dismissed for non removal of defects pointed out by the office.
In that view of the matter, the application seeking condonation of delay is allowed, the delay in filing the restoration application is condoned. The restoration application is allowed.
S.B. Civil Misc. Appeal No. 1533/2013 is restored to its original number.
The appeal was dismissed on account of non removal of defects pointed out by the office in the
miscellaneous appeal.
The defects be removed within a period of one
week now.
