BY THE COURT :
After arguing for some time, the learned counsel for the appellant submits that the appellant has already deposited Rs.75,000/ - pursuant to the order dated 29/ 8/ 2007 passed by this Court, and is ready to deposit the balance amount out of the bill amount of Rs.2,02,703/ - without prejudice to his contentions raised in the appeal, for approaching the Settlement Committee/ Ombudsman for ventilating his grievance in respect of the disputed bill and that he be permitted to withdraw the present second appeal.
