Heard learned counsel for the accused-applicant as well as the learned Public Prosecutor and perused the record of the case.

It is stated that quantity of the drug recovered from the accused-applicant is less than the commercial quantity. No previous case for the offence under the NDPS Act exists against the accused-applicant, thus he may be enlarged on bail.

Learned Public Prosecutor has opposed this bail

application.

After considering all the facts and circumstances of the case and without expressing any opinion on merits of the case, which may otherwise affect outcome of the trial but looking to the facts available on record, I am of the view that accused-applicant deserves to be enlarged on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed. It is ordered that accused-applicant, namely, Jagdish Kumar be released on bail in FIR No.207/2015 registered at Police Station Shahjahanpur, District Alwar for offence under Section 8/20 of NDPS Act provided, he furnishes a personal bond in the sum of Rs.50,000/- together with one surety in the like

amount to the satisfaction of the learned trial Court for his appearance before that Court on all subsequent dates of hearing and as and when called upon to do so.

The accused-applicant would be released by the Court after verification of the fact that no case was earlier registered against him for offence under the NDPS Act. If it is found that previously also, case was registered against the accused-applicant under the NDPS Act, this bail order may be treated as cancelled.
