The present bail application has been filed under Section 439 Cr.P.C. The petitioner has been arrested in connection with FIR No.100/2014, Police Station Dechu, District Jodhpur for the offence under Section 363, 366, 366-A, 376-B, 376(2)(1) IPC and Section 5(G)/ 6 & 5(L)/6 of Protection of Children From Sexual Offence Act.
Learned counsel for the petitioner while praying for bail submitted that the husband registered the FIR on 18.06.2014. Thereafter, the father registered another FIR on 04.07.2014. The entire story has been changed in the second FIR.
Be that as it may, in the statement of girl recorded under Section 161 Cr.P.C. and Section 164 Cr.P.C. IPC, she had made specific allegations against the present petitioner that he had taken her with him on the pretext for dropping her home and kept her in his custody and thereafter, he and others raped her till she escaped.
