The accused-petitioner has filed this third application for grant of bail under Section 439 Cr.P.C. in respect of FIR No.1059/2013 registered at Police Station JDA, Jaipur for the offences under Sections 420, 467 471 read with Section 120-B IPC. The first application filed by the petitioner for grant of bail under Section 439 Cr.P.C. was dismissed by this Court on merit by a reasoned order dated 15.9.2015 at the stage of investigation after considering the evidence collected during the course of investigation. The second application filed by the petitioner was dismissed by this Court vide order dated 03.12.2015 as withdrawn. The present application has mainly been filed by the petitioner on the ground that after investigation charge-sheet has been filed and also on the ground of period of custody of the petitioner.

On consideration of submissions made on behalf of the respective parties and the material made available for my perusal as well as the evidence collected during investigation which has been placed on record by way of copy of the charge-sheet and more particularly looking to the role found of the petitioner in the incident and also his period of custody, but without expressing any final opinion on the merit and demerit of the case, I am now inclined to enlarge the petitioner on bail under Section 439 Cr.P.C.

Consequently, the third bail application filed under Section 439 Cr.P.C. is allowed.

It is ordered that the accused-petitioner-Lala Ram Meena son of Shri Khusalram Meena, in FIR No.1059/2013, registered at Police Station JDA, Jaipur, shall be released on bail; provided he furnishes a personal bond of Rs. 50,000/- (Rupees Fifty thousand only) and two surety bonds of Rs.25,000/- (Rupees Twenty Five thousand only) each to the satisfaction of the learned trial court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
