" उ� �करण म� घटना की िरपोटर् मृतक के िपता होरीराम के �ारा दजर् करवाए जाने पर पुिलस ने वाहन टेम्पू संख्या आर. जे. - 02- पी. - 1143 के चालक के िवरू� स्षम न्यायालय म� आरोप प� पेश िकया है। परन्तु हमारी राय म� केवल टेम्पू के चालक के िवरू� आरोप प� पेश िकए जाने मा� से वाहन टेम्पू संख्या आर जे 02 पी 1143 का इस दुघर्टना म� संिल� होना �मािणत नह� हो जाता तब तक अिधकरण के सम्ष पेश की गई गवाहान की सा�य स�य एवं िव�सनीय सािबत नह� हो जाती। उ� �करण म� पेश िकए गए गवाहान ए. ड. - 2 तथा ए. ड. 3 की सा�य म� घटना के घिटत होने के बारे म� गम्भीर िवरोधाभास है।
इस �कार �स्तुत गवाहान की सा�य म� गम्भीर िवरोधाभास होने के कारण तथा टेम्पू का घटना म� संिल� होना �मािणत नह� होने के कारण इन दोन� िववा�क िबन्दु� का िनणर्य बहक िवप्षीगण िवरू� �ाथ�गण इस �कार िन�णत िकया जाता है।
िववा�क िबन्दु संख्या 1 एवं 3 का िनणर्य �ाथ�गण के िवरू� हो जाने के कारण अन् य िववा�क िबन्दु� पर िवचार िकया जाना न्यायोिचत नह� है।
पिरणामस्वरूप िववा�क िबन्दु संख्या- 1 एवं 3 का िनणर्य �ाथ�गण के िवरू� होने के कारण का धारा 166 एम वी ए�ट का उ� �ाथर्ना प� खािरज िकया जाता है।
आदेशानुसार पंचाट अलग से जारी िकया जावे।"
