This revision petition has been filed against the order dated 21.10.2011 passed by Sessions Judge, Sikar in Cr. Revision Petition No. 168/2011, whereby the order dated 3.9.2011 passed by CJM, Sikar in Cr. Case No. 21/2010 discharging the petitioners for the offence under Sections 498A and 406 IPC, has been setaside.

I have heard learned counsel for the parties and perused the impugned order dated 21.10.2011 passed by the Sessions Judge, Sikar in Cr. Revision Petition No. 168/2011.

I am in unison with the findings arrived at by the appellate court in his order dated 21.10.2011. The relevant part of the order dated 21.10.2011 reads as under:

"�थम ��या यह आदेश �व�धस�मत नह� है| य�द �व�ान अ�धन�थ �यायालय को �करण क� अंवी�ा का �े�ा�धकार नह� था तो उ�मो�चत करने का �े�ा�धकार भी नह� हो सकता| �व�ान अ�धन�थ �यायालय ने यह माना �क सीकर �याय�े� मे कोई अपराध घ�टत नह� हुआ तो चू� �याय�े� मे घ�टत अपराध के �लये सीकर �याय�े� क� �यायालय �व�धअनुसार उ�मो�चत नह� कर

सकती| �व�ान अ�धन�थ �यायालय के सम� यह �वक�प था �क वह प�रवाद व आरोप प� को सम� �यायालय मे ��तुत करने के �लए लौटाती|

प�रि�थ�तया जो भी हो 2011(2) सी.जे. (��मनल) (सु�ीम कोट�) 601 सुनीता कुमार� क�यप बनाम �बहार रा�य �या�यक ��ांत मे माननीय उ�चतम �यायालय ने यह �नधा � रत �कया है �क य�द अपराध एक से अ�धक �े�ो मे होने वाला स�त �प से जार� रहने वाला अपराध होता है और य�द �थानीय �े� मे प�ी को प�त �ारा दहेज क� मांग पूण� नह� होने के ग�भीर प�रणाम हेतु डराये जाने के कारण होता है तथा �पतृगृह मे �नवास करती है, ऐसी प�रि�थ�तयो मे दंड ��या सि�हता क� धारा 178 के परंतुक (सी) के अनुसार जहाँ प�रवा�दया रहती है उस �यायालय को ऐसे अपराध का सं�ान लेने व �वचारण करने का �े�ा�धकार हा�सल होता है| अ�धन�थ �यायालय का आलो�य आदेश �दनांक 3.9.2011 �व�धस�मत नह� है इस�लये अपा�त �कये जाने यो�य है"

In view of above, I do not think it proper to allow this revision petition and hence, the revision petition filed by the petitioner being bereft of any merit, deserves to be dismissed, which stands dismissed accordingly.

Stay application also stands dismissed accordingly.
