�ाथ� ने यह जमानत �ाथ�नाप� धारा 439 द� ड ���या सं�हता के तहत �� तुत कर जमानत पर � वतं� �कये जाने क� �ाथ�ना क� है।
�ाथ� के �व�ान अ�धव� ता �ाथ� क� ओर से ��तुत इस जमानत �ाथ�नाप� को इस �वतं�ता के साथ वा�पस लेने क� अनुम�त चाहते ह� �क �ाथ� मामले म� चालान पेश होने के उपरा�त �वचारण �यायालय के सम� जमानत �ाथ�नाप� पेश कर सकेगा एवं उसके �ारा त�समय जमानत �ाथ�नाप� पेश �कये जाने क� अव�था म� उ� �यायालय को उसके जमानत �ाथ�नाप� को �नयमानुसार �न�ता�रत �कये जाने का �नद�श �दया जावे।
�व�ान लोक अ�भयोजक ने इसका �वरोध �कया।
�ाथ� के �व�ान अ�धव�ा को �ाथ� क� ओर से ��तुत इस जमानत �ाथ�नाप� को वा�पस लेने क� अनुम�त �दान क� जाती है। �ाथ� क� ओर से ��तुत यह जमानत �ाथ�नाप� अ�तग�त धारा 439 द�ड ���या सं�हता वा�पस �लये जाने के आधार पर �नर�त �कया जाता है। मामले म� चालान पेश होने के उपरा�त �ाथ� �वचारण �यायालय के सम� अपना जमानत �ाथ�नाप� ��तुत कर सकेगा एवं �ाथ� �ारा त�समय �वचारण �यायालय के सम� जमानत �ाथ�नाप� पेश �कया जाता है तो उ� �यायालय उसके ऐसे जमानत �ाथ�नाप� का �न�तारण �व�ध अनुसार करे।
