ाथर्गण की ओर से यह दांिडक िविवध जमानत ्ऺाथर्नाप्ऴ अ�तगर्त धारा 439 द�ड ्ऺि्वया संिहता ्ऺ�तुत िकया गया है।

सं्षेप म� ्ऺ करण के त�य इस ्ऺ कार ह� िक पुिलस थाना खैरथल िजला अलवर पर पंजीब्ष ्ऺथम सूचना िरपोटर् संख्या 163/2014 अ�तगर्त धारा 366, 376, 120बी भारतीय द�ड संिहता के मामले म� अनुसंधान आर�भ िकया गया एवं अनुसंधान के दौरान ्ऺाथर्गण को िगर�तार िकया गया। ्ऺाथर्गण ने अधीन�थ �यायालय के सम्ष जमानत ्ऺाथर्नाप्ऴ ्ऺ�तुत िकया, िजसे अपर सेशन �यायाधीश, संख्या 1, िकशनगढ़बास ने आदेश िदनांक 2.8.2014 के ्षारा िनर�त कर िदया। त�प�ात ्ऺाथर् की ओर से यह जमानत ्ऺाथर्नाप्ऴ इस �यायालय के सम्ष ्ऺ�तुत िकया गया है।्ऺ

ाथर्गण के िव्षान अिधवक् ता का तकर् है िक ्ऺाथर्गण को इस मामले म� झूंठा फंसाया गया है, उसने अिभयोक ् ी शिश के साथ कोई अपराध नहीं िकया है। ्ऺाथर्गण लगभग चार माह से �याियक अिभर्षा म� है। ्ऺाथर्गण का मा्ऴ इतना सा दोष है िक उ�होन� िर�तेदार होने के नाते को�ड ि्ऱंक

िपलाई है। मामले म� अनुसंधान पूणर् होकर चालान पेश िकया जा चुका है। अत: ्ऺाथर्गण को जमानत पर आजाद िकया जावे।

िव्षान लोक अिभयोजक ने इसका िवरोध िकया। उनका कथन है िक अमरिसंह व िगरार्ज के बारे म� अिभयोक ् ी �ीमती शिश ने यह अिभकथन िकया है िक उ�होन� उसे को�ड ि्ऱंक िपलाई और एक कमरे म� ब�द कर िदया। अत: ्ऺाथर्गण की ओर से ्ऺ�तुत इस जमानत ्ऺाथर्नाप्ऴ को िनर�त िकया जावे।

ागण के तक� पर मनन करने एवं उभयप्ष के िव्षान अिधव्व प्ऴावली पर उपल�ध साम्षी का अवलोकन करने के उपरा�त म� ्ऺाथर्गण को जमानत पर आजाद िकया जाना उपयु्व नहीं समझता हूं।

अत: ्ऺाथर्गण की ओर से ्ऺ�तुत यह जमानत ्ऺ ाथर्नाप्ऴ अ�तगर्त धारा 439 द�ड ्ऺि्वया संिहता िनर�त िकया जाता है। िफर भी िवचारण �यायालय को िनद�श िदया जाता है िक वे मामले म� ्ऺाथर्गण के िखलाफ आरोप लगाये जाने के उपरा�त प�्शह िदवस की अविध म� अिभयोक ् ी के बयान लेखब्ष कर� एवं त�प�ात ्ऺाथर्गण उनके सम्ष जमानत ्ऺाथर्नाप्ऴ पेश कर� तो उनके ऐसे जमानत ्ऺाथर्नाप्ऴ का िन�तारण िविध अनुसार करे।
