ाथर् ने यह जमानत ्ऺाथर्नाप्ऴ धारा 439 द� ड ्ऺि्वया संिहता के तहत ्ऺ� तुत कर जमानत पर � वतं्ऴ िकये जाने की ्ऺाथर्ना की है।
्ऺाथर् के िव्षान अिधवक् ता ्ऺाथर् की ओर से ्ऺ�तुत इस जमानत ्ऺाथर्नाप्ऴ को इस �वतं्ऴता के साथ वािपस लेने की अनुमित चाहते ह� िक ्ऺाथर् मामले म� चालान पेश होने के उपरा�त िवचारण �यायालय के सम्ष जमानत ्ऺाथर्नाप्ऴ पेश कर सकेगा एवं उसके ्ष ारा त�समय जमानत ्ऺ ाथर्नाप्ऴ पेश िकये जाने की अव�था म� उ्व �यायालय को उसके जमानत ्ऺ ाथर्नाप्ऴ को िनयमानुसार िन�तािरत िकये जाने का िनद�श िदया जावे।
िव्षान लोक अिभयोजक ने इसका िवरोध िकया। ्ऺ
ाथर् के िव्षान अिधव्व ा को ्ऺ ाथर् की ओर से ्ऺ �तुत इस जमानत्ऺ ाथर्नाप्ऴ को वािपस लेने की अनुमित ्ऺदान की जाती है। ्ऺ ाथर् की ओर से्ऺ �तुत यह जमानत ्ऺाथर्नाप्ऴ अ�तगर्त धारा 439 द�ड ्ऺि्वया संिहता वािपस िलये जाने के आधार पर िनर�त िकया जाता है। मामले म� चालान पेश होने के उपरा�त ्ऺाथर् िवचारण �यायालय के सम्ष अपना जमानत ्ऺाथर्नाप्ऴ ्ऺ�तुत कर सकेगा एवं ्ऺाथर् ्षारा त�समय िवचारण �यायालय के सम्ष जमानत ्ऺाथर्नाप्ऴ पेश िकया जाता है तो उ्व �यायालय उसके ऐसे जमानत ्ऺाथर्नाप्ऴ का िन�तारण िविध अनुसार करे।
