An application has been filed by the petitioners, alongwith an endorsement of no objection by learned counsel appearing for the respondent No.1 Prabhu Narayan Mathur, who appears for the said respondent in S.B. Civil First Appeal No.152/2013 (Smt. Saroj & Ors. vs. Prabhu Narayan Mathur & Anr.) pending before this Court, seeking permission to withdraw the present writ petition, with liberty to contest the similar issue raised in the first appeal i.e. S.B. Civil First Appeal No.152/2013 pending before this Court in view of the fact that during the pendency of this writ petition, the suit came to be decided by the trial court and the first appeal has been filed to inter alia contest the similar issue.
For the reasons mentioned in the application containing no objection of learned counsel for the defendant – Prabhu Narayan Mathur, the same is allowed. The writ petition filed by the

petitioners is dismissed as withdrawn with liberty to contest the issue raised in the present writ petition in the pending S.B. Civil Regular First Appeal No.152/2013.
The stay application also stands dismissed.
