Heard learned counsel for the petitioner.

In this writ petition, the petitioner is physically handicapped Doctor, challenging the validity of the impugned transfer order dated 6.3.2013 whereby he has been transferred from Bhilwara to Dholpur.

Learned counsel for the petitioner submits that looking to the physical condition of the petitioner, the District Collector, Bhilwara sent a letter to the Government for retaining the petitioner at Bhilwara and his case for cancellation of transfer order was also recommended by the Commissioner, Social Justice, Govt. of Raj., Jaipur vide Annexure-10 but respondents are not taking into consideration those documents and adamant to relieve the petitioner, therefore, action of the respondents is

against the principles of natural justice.

Normally, this Court is not interfering in the transfer matters because there is remedy of appeal is provided under the Raj. Civil Service Tribunal Act, 1976 but looking to the peculiar facts and circumstances of this case that the petitioner and his wife both are physically handicapped, this writ petition is disposed of with liberty to the petitioner to file representation before the Director, Medical & Health Services along with certificate of disability within fifteen days from the date of receipt of certified copy of this order. It is expected from the respondents that case of the petitioner will be re-considered sympathetically for retaining him at Bhilwara within one month and till disposal of the representation, the petitioner shall be allowed to work at the place where he was working prior to passing transfer order dated 6.3.2013.
