It is stated that during pendency of the petition,
charge sheet has been filed, thus petitioner wants to withdraw this criminal miscellaneous petition with liberty to raise all the issued before the trial Court as raised herein. Further liberty is prayed to seek revival of the petition under Section 482 of Cr.P.C.
as earlier in this case, an interim order was passed against arrest, thus appeal under the bail application under Section 438 of Cr.PC. was not held to be maintainable.
In view of the prayer made, this criminal
miscellaneous petition is dismissed as withdrawn with liberty to raise all issues at the time of hearing of the case for framing of the charges and to make request for revival of the bail application, if petitioner so chooses.
