The present appeal was filed against the order dated 19.01.2009 passed by the first appellate court, whereby, the suit was remanded back to the trial court for decision afresh on issue No.2.
It is submitted by learned counsel for the appellants the suit itself has been decided by the learned trial court.
In that view of the matter, the appeal has become infructuous and the same is, therefore, dismissed as having become infructuous.
