Heard learned counsel for the petitioners.

The petitioners have filed this writ petition with the

following prayer :-

(a) “by way of writ, order or directions to quash and set aside the action of the respondents by which they have tried to take away the land of the petitioner under notification for extension of N.H. No.11 to 4 lane including the land of the petitioners which was handed over to the petitioners through the civil Court.

(b) by way of writ, order or directions the entire record relating to the land in dispute may kindly be called for and after perusal of the record, the respondents may be directed to make the payment of compensation of land measuring 2 bighas 2 biswas to the petitioner at the rate as awarded to other Khatedars.”

It has, however, been admitted that the land has been acquired in pursuance of the notification issued under the National Highways Act, 1956 and the relief, which now the petitioners claim pertains only to the disbursement of compensation amount.

It has further been submitted that the petitioner has submitted a representation, Annexure-5 on 23.01.2007 to the respondents, but the respondents have so far not disbursed any amount to the petitioner by way of compensation for acquisition of the land of the petitioner.

In the facts and circumstances, it is directed while disposing of the writ petition that the petitioner shall approach the respondent concerned along with a copy of the representation and a copy of this order and the respondent shall take a decision with regard to disbursement of the compensation to the petitioner within two months on submitting a certified copy of this order and the copy of the representation. While taking decision, the respondents are expected to pass a reasoned order and intimate the petitioner about the same.
