The learned Government Counsel Mr. Gopal Raj Calla, who is appearing for the Department, at request, has put in appearance. Service on the proforma respondent No. 7 is dispensed with.

The learned counsel for the parties are ad idem that so far the basic grievance of the petitioner regarding place of posting pursuant to the order dated 07.10.2011 after the appointment on the post of Teacher Gr. II is concerned, the matter stands covered by the order passed today in the batch of petitions led by CWP No. 10634/2011 : Vinod Kumar Vs. State (Education) & Ors. However, in this particular matter, the learned counsel for the petitioner submits that under the peculiar circumstances that the petitioner is already working on the post of Teacher Gr. III and has his own difficulties regarding place of posting on his selection on the post of

Teacher Gr.II; and that in the light of the orders as passed by this Court, the respondents would be taking a policy decision and deciding the representation but until such decision is taken, the last date for joining may be further relaxed in relation to this petitioner.

Though this Court is not inclined to draw a special equity in favour of the petitioner and the petitioner's case shall be governed by the order passed today in the batch of petitions led by CWP No. 10634/2011, however, in the interest of justice, it is observed that if the petitioner makes a request in his representation for enlargement of time for joining, the same may also be given due consideration by the respondents looking to the peculiar circumstances.

With the observations foregoing, this writ petition stands allowed to the extent indicated above.
