The dispute raised in the instant petition
is appealable under the Armed Forces Tribunal
Act, 2007 which provides effective remedy of
appeal and Section 34 stipulates that all
pending matters in any Court including High
Court shall be transferred to the Tribunal
immediately on its constitution.
It has been informed that Bench of the
Tribunal has been established at Jaipur.
The Registry is accordingly directed to
transfer the instant petition to the Bench of
the Tribunal at Jaipur for further adjudication.
The parties may appear before the Tribunal
on 26/11/2009.
The writ petition stands disposed of
accordingly as having been transferred to the
Bench of Army Tribunal at Jaipur.
