Petitioner while working as medical

officer at Govt. Dispensary Paharganj (Ajmer)
was transferred vide order dt. 22/10/09
(Ann.3) & posted at Kamla Nehru TB Centre,
Ajmer (KNTB) while at the same time vide
another order dt.22/10/09 (Ann.4), one Dr.
Rajendra Heda (S.No.291) (respondent-5) was
transferred at KNTB Hosp., Ajmer while Dr.
Durga Deep Makkar (S.No.155) (respondent-6)

was also transferred at KNTB Training Centre,
Ajmer.

Her grievance is that despite she
having submitted joining report at the place
of her posting (Kamla Nehru TB Centre, Ajmer)
in pursuance of her transfer order dt.22/10/09
(Ann.3), Chief Medical & Health Officer is not
permitting her to join, which is causing
prejudice.

It appears that while passing orders
dt.22/10/09 (Ann.3 & 4), respondent authority
has not taken note of the fact as to who has

been posted on transfer against vacant post
and simultaneously orders were issued on
22/10/2009, which has resulted in creating
problem for employees to join in pursuance of
respective orders of their transfers.
Grievance of petitioner appears to be
justified and if she wishes to join on
transfer at the place of her posting, it is
also for the authority to permit her to join
or to pass fresh posting orders in the
interest of administration; but it is not for
this court to examine administrative exigency.

Without expressing any opinion on
merits, the writ petition stands disposed of
with direction to the petitioner to submit
fresh representation within one week raising
her grievance before competent authority which
may objectively consider the same and pass
necessary order within two weeks thereafter
and communicate the same to her, till then
petitioner shall be allowed to report in the
office of CMHO Ajmer (respondent-3).
