Nagar Palika was transferred from Ameth
(Rajsamand) to Chhoti Sadri (Pratapgarh) vide
order dt.15/10/09 (Ann.1) – in pursuance
whereof, also reported for duty at Chhoti
Sadri but was not allowed to join on the
premise of there being no vacant post vide
order dt.22/10/09 (Ann.3).

His grievance is that if he is not
permitted to join, it would cause prejudice
and the department may also take action
against him. There appears to be some
justification in what has been urged by
respondent vide letter dt.22/10/09 (Ann.3)
that in case of there having no vacant post
available in Nagar Palika, Chhoti Sadari,

certainly he may not be permitted to join.

Without expressing any opinion on

merits, the writ petition stands disposed of
with direction to the petitioner to submit
fresh representation within one week raising

his grievance before the Director, Local-Self
Government Jaipur (respondent-2)) who may
objectively consider the same and pass
necessary order with regard to his posting
within two weeks thereafter and communicate
the same, till then petitioner will be allowed
