This is the defendant's writ petition against the impugned order dated 1.11.2007 by which the appeal filed by the defendant against the order passed on the application for grant of temporary injunction dated 29.8.2007 has been dismissed.
Heard learned counsel for the parties and perused the impugned order. As per the trial court the parties have been directed to maintain status quo with regard to the property in dispute during the pendency of the suit. Since the suit itself is for grant of permanent injunction for restraining the petitioner defendant from alienating the property in dispute I find no reason to interfere with the impugned order in writ jurisdiction under Articles 226 and 227 of the Constitution of India as there is no jurisdictional error committed by the courts below.
This writ petition is accordingly dismissed summarily. The stay application is also dismissed.
