Instant petitions were filed basically
against order dt.30/12/98 whereby promotion given
to 112 work-charged employees was cancelled.

Pendente instant petitions, respondents
further passed order dt.30/01/99 (Ann.7) whereby
order of reversion of 112 work-charged employees
pursuant to order dt.30/12/98 was kept in
abeyance. However, petitioners were later on given
promotion and financial benefits were also
extended to them. It appears that the order
impugned which caused prejudice to the petitioners
has not been given effect to at later point of
time; and since subsequently they have been
promoted, order impugned in changed circumstances
looses its effect. Since there is no order, which
may cause any prejudice to the petitioner, instant
petitions at this stage have become infructuous.

Consequently, both the writ petitions are
dismissed alongwith stay petition as having become
infructuous. However, if any order prejudicial to
the petitioners is passed, they will be free to
avail of remedy available under law.
