Instant petition has been filed for

alleged non-compliance of order dt.30/11/04 of
this Court in CWP-715/96.

Counsel for petitioners submits that

principal amount was paid to the petitioners but
as regards interest part, Presiding Officer under
Workmen Compensation Act on re-appreciation of

material exonerated truck owner and the insurer
also, whereas direction of this Court was only to
examine as to what extent they were responsible
and who has to meet out payment of interest. It
has also been informed that against subsequent
order passed by Workman Compensation Commissioner,
to whom matter was remanded, petitioners have
preferred CMA-1775/07 pending before this Court.

The interpretation made of the order of
which contempt is alleged, cannot be said to be
deliberate and this Court does not find any

justification to continue with proceedings in
instant contempt petition.

Consequently, contempt petition is hereby

dismissed. Notices issued stand discharged.
However, dismissal of contempt petition shall not
cause any prejudice to the rights of petitioners
in examining their grievance raised in appeal
(supra) pending before this Court.
