This writ petition has been filed against

the order passed by the District Collector whereby the petitioner has been required to pay Rs.34904/with interest of Rs.6283/- thus, total sum of Rs.41187/- has been demanded from the petitioner to be deposited with the respondents.

It is contended that even though the original lease deed issued to the petitioner contained stipulation that allotment shall be for the period of 99 years but lateron, the Collector overriding that stipulation, ordered that lease shall be only for a period of 30 years. Clause (iii) of the order of Collector provides that petitioner shall be required to pay only amount equivalent to 5% of the mortgage valud of the agricultural land with stipulation that such amount shall be liable to be raised @ 5% per annum.

Having regard to the facts of the case, instead of directly entertaining this writ petition, I set the petitioner at liberty to approach the Revenue Secretary of the Government of Rajasthan by making an appropriate representation who shall upon hearing the petitioner shall consider and decide the same within three months from the date of making such representation.
