This is admitted position of the case that against the order dated 22.3.2007, the petitioner has already preferred an appeal before the Dy. Commissioner (Appeals), Jodhpur and the same is still pending. The petitioner has preferred the present writ petition under the apprehension that in similar circumstances in other appeal filed by him against the order of Assistant Commissioner, Special Circle-II, Commercial Taxes Department, Jodhpur, the application for interim relief was rejected against which he has preferred the writ petition before this Court. The same was registered as SB Civil Writ Petition Nol.4411/2007 and decided vide order dated 27.7.2007 in which this Hon'ble Court passed an order that appeal against the order dated 24.3.2006 passed by Commercial Taxes Officer, Circle-B, Jodhpur is pending and stay was refused in the month of Sptember, 2006 and now in May, 2007, notice was issued for recovery of demand. Therefore, in the interest of justice, the appellate authority was directed to decide the appeal within a period of two months from the date of order and it was also ordered that till then no coercive action shall be taken against the petitioner.
