La n d of the appellant and othe r land owners situated in village Basai, Tehsil a n d District Gurugram, was noti f ied for acquisition on 25.05.2010 under Section 4 of the Land Acquisition A ct, 1894, followed by anot h er notification da t ed 25.05.2011 under Section 6 of the Act ibid. Vide award No.33 dated 30.01.2013, the Land Acquisition Colle c tor assessed the market value of the acquired land @ ₹1,50,00,000/- per acre. R eference petitions under Section 18 of the Act w ere filed by the appellant as well as various land owner. The Reference Cou r t vide its award dated 02.01.2 0 23 assessed the market value of the land of the appellant @ ₹2,62,08,000/- p e r acre apart from other statut o ry benefits.

By way of this appeal, the appella n ts seek further enhancement.

It is submitted at the outset by l e arned counsel for the appella n ts that it is a cov e red case, inasmuch as several other land owners, aggrieved by

the valuation assessed by the Reference Cour t , had preferred separate Regular First Appeals b e fore this Court and a Co-ordinate Bench, in a bunch of appe a ls, led by RFA No. 1528 of 2018 titled ‘Raj Kumar (deceased) through LRs & Anr. Vs. State of Haryana & Ors.’ vide judgment dated 18.10.2022 (Annexure P-1) has determine d the market value of the acquir e d land @ ₹3,27,06,044/- per a c re along with oth e r statutory benefits. Learned counsel submits that this app e al may be disposed of in terms of the said order d ated 18.10.2022.

Le a rned AAG Haryana does not dispute this factual position b ut informs that ot h er land owners have filed SLP ( C) 020013-020042 of 2023 bef o re Hon’ble Supre m e Court; whereas the State has filed SLP(c) 13825-13841 of 20 2 3, which are pending before Hon’ble Supreme Co u rt.

At this, learned counsel for the appellant submits that this app e al may be disposed of subject to the outcome of SLPs pending before Hon’ b le Supreme Court .

Ta k ing into account the judicial discipline of maintaining parity while simultan e ously preventing undue finan c ial burden on the acquiring body arising from de l ayed filing, this Court holds tha t the appellant shall be entitled to compensation @ ₹3,27,06,044/- per acre, alon g with all statutory benefits un d er the Land Acqui s ition Act, 1894.
