By way of filing the pres e nt appeal, challenge has b e en laid to the decision dated 14.08.1997 passed by the Court of lear n ed Addition a l District Judge, Hoshiarpu r , whereby application preferred under S e ction 92 read with Section 151 of the Civil Procedure Code, 1908 at t he instance of appellants/ pl a intiffs seeking permission to file suit for declaration, stands declined.

I have heard learned co u nsel for the parties and g o ne through t he paper-book.

A perusal of the record shows that previously also, similar prayer w as made on behalf of the a p pellants which was declined by the Cou r t vide order dated 20.05.1 9 95 passed in LTA-43 of 1994. Further, it has also been establish e d on record that the present

proceedings were initiated at the ins t ance/ motivation of one Pritam Singh, w ho was already engaged in litigation with respondent No.1 concerning the management of Dera a nd also its properties.

Furthermore, no materia l has been placed before t his Court to establish that the appellants/ landowners possessed any r eal or subst a ntive interest either in the D e ra (Dera Gurudwara Bhai D u lla Singh, Hoshiarpur) or in any of its pro p erties.

In view of the aforesaid, t h e order passed by the Cour t of Addition a l District Judge, Hoshiar p ur, being based on proper appreciation of pleadings and the m a terial available on record, c a lls for no in t erference. Accordingly, the present appeal, being devoi d of merit, is t hus, dismissed.
