1 . The present Letter Patent Appeal has been filed against the judgment dated 08.02.2021 passed by the learned Single Judge, in CWP2796-2021 , titled Tajender Kumar and others vs. Haryana Staff Selection Commission and another , whereby the writ petition filed by the petitioners (appellants herein) seeking quashing of Advertisement No. 6/2020, Category No. 22, dated 20.07.2006 for the post of Art and Craft Teacher, as well as the written examination already conducted by the respondentCommission on 31.01.2021 has been dismissed.

2 . Learned Senior Counsel appearing on behalf of the appellants submits that the order passed by the learned Single Judge dismissing the writ petition in limine is erroneous. He submits that during the pendency of the present appeal, the selection process has been finalized and the selected

candidates have already been appointed.

Learned State counsel, on the other hand, submits that the learned Single Judge has considered all the allegations raised by the appellants in the writ petition and has held that no cogent evidence has been brought on record to substantiate the allegations of malpractice or irregularity in the selection process by respondents No. 1 and 2.

4 . Learned counsel for the State further submits that the allegations levelled by the appellants have not been proved even against the selected candidates.

5 . We have heard learned Senior Counsel for the appellants, as well as learned counsel for the State and have gone through the record carefully.

It may be noticed that unless and until cogent evidence is brought on record to show that the selection process is tainted, mere irregularities, which do not go to the root of the matter, cannot be allowed to operate so as to set aside the selection which has already attained finality and the selected candidates have already joined service.

7 . It may be noticed that the allegations in the present appeal are that though the candidates at the other centres were given a particular paper, the appellants were given another set of question papers, which had caused prejudice to them.

8 . Further, the candidates have already joined service and are working for the last more than four years. Most of them are not parties to the present appeal and nothing has come on record to show that they have

misconducted so as to oust the selection and appointment of selected candidates on the basis of the allegations of the appellants, which have not been substantiated otherwise.

9 . No ground is made out to interfere with the judgment passed by the learned Single Judge.

10. The appeal stands dismissed.
