By way of filing the present appeal, appellant/owner of the offending vehicle lays challenge to the impugned Award dated 16.11.201 7 , passed by the Motor Accid e nt Claims Tribunal, Ludhaina whereby a n amount of ₹10,88,400/- to cla i mants/respondents No. 1 and 2 in MACT N o. 12 dated 04.04.2009 filed u nder Section 166 of the Motor Vehicles A ct, 1988; and recovery rights h a ve been granted to respondent No. 4-In s urance Company to recove r the aforesaid amount of compensat i on from the owner/appellant a nd driver/respondent No. 3 of the offending vehicle.

The matter pertains to the ye a r 2019 and notice of motion is yet to be i s sued in the same as, since the i n ception of appeal the same was listed for h earing 03 times, out of whi c h on 02 dates of hearing i.e. 07.01.202 0 and 19.01.2023, the same w a s adjourned at the request of learned co u nsel for the appellant; wherea s on the 3^rd date i.e. 27.08.2025 (last date of hearing), the present appe a l was adjourned due to nonappearanc e on behalf of the appellant. round of h earing, none has put in appear a nce on behalf of the appellant. Moreover, there is delay of 88 days in fili n g and 148 days in refilling the present ap p eal.

A bare reading of the above facts shows that the appellant has exhib i ted an utterly casual attitude in his pursuit of the present litigation. I t is to be appreciated that ve r y valuable public time of the Court has b een expended in affording opp o rtunities to the appellant in the interest of j ustice. On the other hand, the a ppellant has adopted an utterly casual and careless approach. It is clear t h at neither the appellant nor his counsel is seriously interested in pursuin g the present matter. Thus, this Court is l e ft with no other option excep t to dismiss the same for nonprosecutio n .
