The present writ petition u n der Articles 226/227 of the Constituti o n of India has been filed f or quashing the order dated 16.02.201 8 (Annexure P-8) passed by re s pondent No. 2 in violation of statutory p r ovision and judgment dated 12.01.2018 passed by the Division Bench of t h is Court wherein the responde n t-State undertook to implement the seniority list in PWD/B&R Departm e nt as per the length of service and furthe r promote the concerned engine e rs accordingly. 2. At the very outset, on instr u ctions learned counsel for the petitioners submits that the present petitio n has been rendered infructuous and may b e disposed of, as such. 3. On the last date of hearing i . e. 13.07.2026, following order has been p a ssed by this Court:-

“It is pointed out b y learned counsel for the respondent-State that praye r of the petitioner(s) in the present writ petition is f o r quashing of order dated 16.02.2018 (Annexure P-8) w hereby petitioner was seeking fresh seniority list on the basi s of judgment dated 12.01.2028 passed by the Division Benc h of this Court in CWP-198412013 and other connected matters. However, the said judgment was set aside by the Hon’ble Supreme Court vide judgment dated 05.08.2021 (A nnexure R-1) passed in Civil Appeal Nos. 3409-3410/202 0 titled as ‘S.K. Sharma and others vs. The State of Harya n a and others’. It is accordingly submitted that there is no m e rit in both the aforementioned writ petitions, in view of l a w laid down by the Hon’ble Supreme Court in S.K. Sharma’s case (supra).

Perusal of the order-sheet(s) reveal(s) that this fact was brought to the notice of a co-ordinate Bench of this Court as well by the learned c ounsel for the State as noted in the order dated 15.05.2023. Thereafter, the matter was repeatedly adjourned either at the request of learned counsel for the petitioner(s) or on a ccount of non-appearance on behalf the petitioner(s).

Today, again learn e d proxy counsel for the petitioner(s) prays for an a dj ournment on the ground that leaned arguing counsel is in d isposed. Similar is the position on the last date of hearing i.e. on 25.02.2026.
