The petition has been filed inter alia seeking a writ of certiorari quashing the order dated 27.05.2026, Annexure P-11, passed by the second respondent/Registrar General of Societies, Haryana, whereby directions have been issued to the returning officer to complete the election process in the Society/Bahadurgarh Chamber of Commerce and Industry (BCCI) within seven days. The directions issued read as under:

Further, the Ld. District Registrar of Societies, Jhajjar, Bahadurgarh shall, in consultation with the Ld. Deputy Commissioner, Jhajjar, constitute an independent committee for the purpose of verification and rectification of the membership/voter list. The said committee shall submit the final membership/voter list before the Ld. District Registrar of Societies, Jhajjar, Bahadurgarh within a period of 10 days and, upon receipt of the report along with the verified membership/voter list, the Ld. District Registrar of Societies, Jhajjar, Bahadurgarh shall dispose of the petition under Section

39(4) of the HRRS Act, 2012-within a period of 7 days thereafter. Pursuant thereto, the Returning Officer shall complete the election process within a further period of 7 days. 2. Learned counsel for the petitioner contended that the directions

are violative of the provisions of Section 39(4) of the Haryana Registration and Regulation of Societies Act, 2012 (for short, ‘the 2012 Act’), which prescribe that any person aggrieved with the published list of members of the society may file a petition with the District Registrar within a period of fifteen days of publication of the list of members. Further, in terms of subsection (6), the District Registrar shall hold the election process in abeyance and proceed to conduct an inquiry in this regard. And in terms of sub-section (8), only upon completion of inquiry, he shall determine the list of members eligible to vote, make it public and set the election process in motion. Therefore, the directions being contrary to these stipulations are not sustainable.

Learned State counsel is not in a position to dispute that the said directions in the impugned order are violative of the statutory provisions. He, however, submits that in terms of those directions, an independent committee for verification and rectification of voter list has already been constituted by the District Registrar vide order dated 02.07.2026. The committee shall undertake the exercise and submit its report along with verified membership/voter list to the District Registrar, who will then publish the same inviting objections which will be dealt with in accordance with procedure prescribed under Section 39 of the 2012 Act.

In view thereof, the petition stands disposed of by modifying the directions issued in the impugned order, dated 27.05.2026, that on receiving the verified membership/voter list by the committee constituted vide order dated 02.07.2026, the third respondent/District Registrar of

Societies, Jhajjar, shall commence the process of election and conclude the same strictly in accordance with the procedure prescribed under Section 39 of the 2012 Act as well as the Bye-laws of the BCCI.
