Instant petition has been filed under Article 226 of the Constitution of India for directing the respondents to fix the pay of the petitioner in the pay scale of rs.10300-34800 + 4200 GP as revised by the 6^th Pay Commission instead of pay scale of Rs.29,100/- as per the 7^th Central Pay Commission, as the pay is to be given to the petitioner as per the statutory rules and as per the advertisement dated 09.11.2025 (Annexure P-2), which pay scale has been granted to other selected candidates including persons lower in merit who have been appointed vide order dated 11.09.2016 (Annexure P-5) on the post of ETT Teachers against the same advertisement as the action of the respondents is against the law laid down by this Court in the judgment

dated 13.09.2024 (Annexure P-7) in CWP-15896 of 2023 – Saurabh Sharma and others v. State of Punjab and another , which has been upheld in LPA-2977 of 2024 – State of Punjab and another v. Dr. Saurabh Sharma and others decided on 10.12.2024 (Annexure P-8) and the SLP filed against the said judgments has also been dismissed. Further prayer has been made that the Clause inserted in the appointment letter of the petitioner dated 04.12.2024 (Annexure P-4) to the extent of granting 7^th Pay Scale instead of pay scale prescribed for ETT Teachers under the statutory rules and as per advertisement dated 09.11.2025 (Annexure P-2) and in terms of the aforesaid judgments and for directing the respondents to grant seniority and pay fixation and promotion at par with his batchmates who have been selected and appointed in 2016 against the same advertisement dated 09.11.2015 (Annexure P-2) with all consequential benefits in terms of judgment dated 06.03.2020 (Annexure P-11) and judgment dated 07.08.2012 (Annexure P-12).

Learned counsel for the petitioner submits that for the redressal of his grievance, petitioner has served a legal notice dated 20.03.2026 (Annexure P-10) upon the respondents, however, the same is still pending consideration. Learned counsel for the petitioner confines his prayer for deciding legal notice dated 20.03.2026 (Annexure P-10) and submits that at this stage, petitioner would be satisfied, if the said legal notice is considered and disposed of by passing a speaking order in a time-bound frame.

Without expressing any opinion on the merits of the case or the claim being made by the petitioner in the present petition, respondent No.3 is directed to consider and decide the claim made by the petitioner in the legal notice dated 20.03.2026 (Annexure P-10) in accordance with law, by passing a speaking order within a period of three months from the date of receipt of certified copy of this order.
