This is an application filed under Order 1 Rule 10 CPC read with Section 151 CPC for impleadment of State of Haryana through Commissioner and Secretary to Government Haryana, Industries and Commerce Department, Chandigarh, as respondent No.3.

For the reasons stated in the application which is duly supported by an affidavit and not opposed by learned counsel for the petitioners, the present application is allowed and State of Haryana through Commissioner and Secretary to Government Haryana, Industries and Commerce Department, Chandigarh is ordered to be impleaded as respondent No.3.

Amended memo of parties is taken on record, subject to all just exceptions.

Civil Writ Petition under Article 226 of the Constitution of India for issuance of a writ in the nature of Certiorari for quashing the notification dated 09.08.2007 issued under section 6 of the Land Acquisition Act, 1894 (Annexure P-1), vide which the land of the petitioner has been finally acquired, and further, a writ in the nature of Mandamus directing the respondents to release the land belongs the petitioners, whereas the discriminatory manner as of malpractice adopted with regard to acquisition and release of similarly situated land under Acquisition, and further, directing the respondents to consider the case and to release the land as per Section 24 (2) of the Act i.e. the Right of Fair Compensation and Transparency in the Land Acquisition Act, 2013 as the petitioners is still in physical possession of the land in question, and payment of compensation has not been paid and still laying in the office of LAC.”
