This is a Civil Writ Petition filed under Article 226/227 of the Constitution of India for the issuance of a writ in the nature of mandamus directing the respondents to handover the physical possession along with proper demarcation of plot No.5, Sector 51, Gurugram, Haryana.

Counsel for the petitioner states that petitioner’s grandfather was allotted/re-allotted plot thrice, because the earlier allotted plots were disputed. He submits that the last allotment was made vide letter, dated 23.06.2014, Annexure P-

6, whereby Plot No.5, Sector 51, Gurugram, was allotted. He submits that by virtue of the impugned Show Cause Notice, dated 19.08.2021, Annexure P-8, respondents have threatened to cancel the allotment of plot No.1306, Sector 51, Gurugram, which was a disputed plot. He asserts that in lieu of this plot, Plot No.5, Sector 51, Gurugram already stood allotted to petitioner’s grandfather, who has expired in the year 2022. Counsel states that petitioner has a Will, dated 01.11.2019, Annexure P-1, in his favour and has sent response to the impugned Show Cause Notice, which has not been withdrawn by the respondents.

Mr. Deepak Bhardwaj, Advocate puts in appearance on behalf of the respondents-HSVP and requests for deferment to get instructions.

Learned counsel for the petitioner has submitted that for his grievance, the petitioner has also given representation dated 18.12.2024 to Estate Officer-II, Gurugram-respondent No.2 and would be satisfied at this stage, in case respondent No.2 is directed to decide the same in a time bound manner.

Learned counsel for the respondents has submitted that the said representation dated 18.12.2024 would be considered and decided by respondent No.2, within a period of three weeks from today and in case the pleas of the petitioner are found to be meritorious then necessary relief would also be granted to the petitioner.
