For the reasons stated in th e application and in view of submissions made by learned counsel for the applicant-petitioner, order dated 19.05.2026 passed in CRWP-1754-2026 is recalled and the main case is directed to b e restored to its original number a nd status. The main case is taken on Board to d ay itself.

“ PRAYER - It is therefore respect fu lly prayed that in view of the facts and circumstances and in the inter es t of justice, this Hon'ble Court may be pleased to :- issuance of an appr o priate order or directing respondent No. 2 to provide immediate and e ffective protection to the life and personal liberty of the petitioner a nd her family members, who are under grave and imminent thr e at at the hands of the private respondents, who have murdered t he husband of the petitioner, Late Harnek Singh, and are continu ou sly issuing threats, intimidating, following and pressurising the pe ti tioner to withdraw the case, being accused in DDR No. 13 dated 07.0 2 .2025 registered on the statement of the petitioner under Sections 103, 109, 309(4), 3(5) of the Bharatiya

Nyaya Sanhita, 2023 and Sections 25 and 27 of the Arms Act was registered at Police Station Fatehgarh Churian District: Batala, Distret Gurdaspur, Anexure P-2 clearly naming the real culprits, who despite committing the murder are roaming freely in public and posing a serious threat to the life and liberty of the petitioner.

Further issuance of an appropriate writ, order or direction directing respondent No. 2 to the constitution of an independent Special Investigation Team (SIT), preferably comprising senior police officers from outside the district, and/or transfer of the investigation to an officer of impeccable integrity from another district, to conduct a fresh, fair, impartial, and independent investigation into the murder of the petitioner's husband, Late Harnek Singh, so as to ensure that justice is not defeated and the rule of law is upheld

The petitioners further pray for issuance of directions to respondent No. 2 to decide their representation in a time-bound manner and take appropriate legal action on the basis of the allegations contained in the representation annexed as Annexures P-1 The petitioners also seek necessary police protection to safeguard their life and property, as despite submitting detailed representations seeking protection, no action has been taken by the authorities to date. ”

Learned counsel for the petitioner submits that the petitioner

would be satisfied, in case a direction is issued to Senior Superintendent of Police, Batala to consider and take a conscious decision on the representation dated 05.01.2026 (Annexure P-4) made by the petitioner.

On the other hand, on the asking of the Court, Mr. Adhiraj Singh Thind, AAG Punjab causes appearance on behalf of respondents No.1 to 4 and submits that grievance of the petitioner will be looked into by Senior Superintendent of Police, Batala and it shall take decision either way, on the representation dated 05.01.2026 (Annexure P-4) of the petitioner.

Given the nature of order being passed, there is no necessity to seek reply by any of the respondents as no further proceedings and/or pleadings are required.

Without commenting on the merits of the case, the petition in hand is disposed of with a direction to Senior Superintendent of Police, Batala to consider representation dated 05.01.2026 (Annexure P-4) of the petitioner and take a ratiocinated decision thereupon, in accordance with law, within a period of 03 weeks from the date of receipt/ production of certified copy of this
