T hrough the instant petition filed under Section 482 of th e Bharatiya Na g arik Suraksha Sanhita, 2023 (f o r short “BNSS”), the petitione r seeks anticip a tory bail in case FIR No.89 da t ed 03.07.2025 registered unde r Sections 103 a nd 3(5) of the Bharatiya Nyaya Sanhita, 2023, at Police Statio n Kathu Nangal, District Amritsar.

O n 17.04.2026, the following or d er was passed by this Court: -

“Prayer in the present pe t ition filed under Section 482 o f t h e BNSS, 2023 is for grant of a n ticipatory bail to the petitioner s i n case FIR No.89 dated 03.07.2025 registered under Section s 103 and 3(5) of the Bharatiya N yaya Sanhita, 2023, at Polic e S tation Kathu Nangal, District A m ritsar.

Learned counsel for the p etitioner has submitted that th e petitioner has been falsely impli c ated in the present case and h e has no concern with the demise o f father of the complainant. H e argued that the petitioner was i ntentionally named in the FI R only on the basis of suspicion wi t hout any concrete evidence. H e f u rther argued in fact, some m o netary transactions were goin g on between the petitioner and f a ther of the complainant as th e petitioner is running the busi n ess of commission agent. H e f u rther argued that there was a considerable amount outstandin g a g ainst the complainant's fath e r Sawinder Singh, which th e petititoner was demanding from him but instead of paying th e s a me, the complainant got regi s tered another false FIR No.4 0 d ated 26.04.2025 against the p etitioner. Moreover, the dea d body of the father of the comp l ainant was recovered from hi s own fields and it was a natural de ath as there was no sign of an y ki nd of injury. He further submi t ted that with the intervention o f t h e respectables, the matter w as compromised between th e parties and the same has been p l aced on record (Annexure P-2) . M oreover, the petitioner has c lean antecedent as he is no t i n volved in any other case and n o recovery is to be effected fro m him. Learned counsel has furthe r submitted that the petitioner i s r e ady and willing to join the investigation as and when calle d u p on to do so by the investigatin g agency.

On the other hand, learne d State counsel has already file d t h e status report in the matter an d while referring to the same, h e has opposed the prayer for g rant of anticipatory bail, b y s u bmitting that the allegations l e velled against the petitioner ar e s e rious in nature as he was speci f ically named in the FIR. Adjourned to 28.04.2026.

In the meantime, the p etitioner is directed to joi n i n vestigation within a week from today and would appear as an d w hen required by the Investiga t ing Officer and cooperate wit h t h e Investigating Agency. L earned counsel for the petition e r submits that in compliance o f the orders d a ted 17.04.2026 and 28.04.20 2 6 passed by this Court, th e petitioner has j oined the investigation.

L earned counsel for the State, o n instructions from SI Narinde r Singh, has su b mitted that the petitioner has j o ined the investigation and is n o longer required for further investigation.

I n view of the statement made by learned State counsel, th e interim order dated 17.04.2026 passed by th i s Court, is made absolute. Th e petitioner sh a ll continue to join investigati o n, as and when called by th e Investigating O fficer and shall also abide by t he conditions as provided unde r Section 482(2 ) of the BNSS.
